PRIVACY POLICY

This privacy policy (“Policy” or “Global Policy”) is Bridgestone Corporation’s global policy for online and/or downloadable system(s), application(s) and/or software(s) defined below (“System”).

The System: BASYS

Please see Appendix A as well for additional information by country.

We, Bridgestone Corporation (“Bridgestone”, “we”, “our”, or “us”), provides the System for companies in the tires/vehicles-related industry (“User Company(-ies)”) for business use.

In accordance with the TERMS & CONDITIONS / END USER-LICENSE AGREEMENT and applicable contractual arrangements with us and/or Service Providers defined in Section 1 below, User Company may register its directors and employees as users of the System (“User(s)”, “you”, “your”, or “yours”), and complete user accounts.

This Policy describes how and why information of a personal and/or private nature (“Personal Data”) are collected, used and shared through the System.

1 The System

The System functions as described below (collectively, as “Functionality (-ies)”):

: as customers, tires, and vehicles-related information management tool with user interface, input form, and reporting function ("Sales/Tire Management Functionality”); and

: as data analysis engine with ability to store, process, and analyze, then output tire/vehicle-related information by analyzing and processing input data such as casing acceptance rates, average numbers of repairs needed and number of life cycles of their casings, etc. (“Data Analysis Functionality”);
AND
ENABLES
tire consultants and service providers (”Service Provider(s)”) to provide tire dealers, truck, bus, and other vehicle fleet customers and casing collectors (”Customer(s)”) with the ability to track, report and optimize their tire usage, tire consumption, tire performance, fuel optimization practices, wear and damage reduction measures, tire selection, tire inspection and maintenance practices. (The benefit which Service Providers and Customers (collectively User Company(-ies)) may have by using the System, is hereinafter referred to as “Interest”.)

2 Purpose of Use of Personal Data

We use Personal Data and relevant data described in Section 3 for the following purposes(“Purpose(s)”):

To serve the Interest of the User Company which has obtained usage rights pertaining to the System(s), involving the processing of Personal Data of Users relating to the creation of accounts and granting access permission to the Users as instructed by each User Company, and to have necessary communication with User Company and/or Users for the above mentioned purpose, and within the framework of the Terms and Conditions;

To allow the User Company functional use of the System, including the Sales/Tire Management Functionality and/or Data Analysis Functionality;

To operate, maintain, provide customer support, improve, and enhance the System, Functionalities, user experience and Interest, and to develop new services, products, and systems; and

4

Other purposes as may be permitted by the applicable laws and regulations.

3 Processing and Collection of Personal Data

We will collect, obtain, and record through the System and keep the following Personal Data, to the extent necessary for the purpose as described in Section 2 (Purpose of Use of Personal Data) and in accordance with the applicable laws and regulations:

(a) Name, email address, phone number(s) (optional) , picture (optional) of User, for the Sales/Tire Management Functionality; and

(b) Timing of telecommunication/data transfer (of data of tire/vehicle-related parameters and of the offices/or facilities, which may be personally identifiable data of vehicle drivers and maintenance employees (jointly with Users referred to as “Data Subjects”) combined with other information the User Company has in its possession) captured by peripheral equipment for services which may be provided by Service Providers, at the choice of each Customer.

In addition to the above, we collect, obtain, record and keep Cookies, cache, IP address, and modules (”Cookies and Identifiers”) which may constitute Personal Data.
For Cookies and Identifiers, please refer to our Cookies Policy(Appendix B).

In circumstances where you provide us with Personal Data relating to other individuals, you represent and warrant that you have obtained such individual’s consent for, and hereby consent on behalf of such individual to, the collection, use, disclosure and processing of his/her Personal Data by us.

4 How we treat Personal Data

We treat Personal Data and relevant data described in Section 3 in a legitimate and appropriate manner, including, but not limited to, the following processing:

We apply an appropriate and reasonable level of security control action, which include physical, electronic, and administrative procedures to protect and secure Personal Data and relevant information in a safe manner as defined and/or recommended in the applicable laws, regulations, and guidelines (including, of course, the Act on the Protection of Personal Information, Japan).

We take appropriate steps to keep the Personal Data and relevant data correct and up-to-date, and delete such Personal Data when they are no longer needed.

5 To whom do we transfer and/or disclose Personal Data?

We disclose Personal Data and relevant data described in Section 3 only for the Purposes, to third parties as described below. We take appropriate steps to ensure that Personal Data and relevant data are processed, secured, and transferred according to applicable laws.

To external data processors (“Sub-Processor(s)”).

For example, database providers, telecommunication service providers, and data analysis professionals which perform certain tasks on our behalf or will have opportunity to access Personal Data and relevant data to perform their services for us, to the extent necessary for us to process Personal Data and relevant data for the Purposes. Sub-Processors are under our contractual and practical control and oversight, and no Personal Data and relevant data are used for Processors’ own purposes.

To User Company.

(a) User Company which decides to use, and instructs Users to use, the System, or makes other employees (such as vehicle drivers or maintenance personnel) the subject of the data processing by the System, is the ultimate responsible entity which has determined to have your Personal Data and relevant data processed by us. It is the User Company’s sole responsibility to process its employees’ Personal Data and relevant data in accordance with the laws applicable to the contractual relationship with its employees, and

(b) A Customer and a Service Provider, which a User Company may have entered into a contractual relationship withthe provision of tire-related services, involving the exchange of certain information including Personal Data and relevant data for their business processed through the System. Both Service Provider and Customer shall take appropriate data protection and security measures under their own responsibility.

The User Company shall be the first point of contact for inquiries about how Personal Data and relevant data of Users and other of their employees are treated.

Within Bridgestone Group

Bridgestone is part of a global organization (the “Bridgestone Group”), consisting of several companies in Europe, U.S., and elsewhere. The Personal Data and relevant data may be transferred to one or more Bridgestone Group affiliated companies located in or outside Japan as needed for the Purposes as described in Section 2.

6 International Transfer

To the extent necessary for the Purpose we transfer Personal Data and relevant data to the countries outside Japan. The transfer is only to our local facility or the third parties described in Section 5. We will take necessary and appropriate measures to comply with applicable laws and regulations.

7 Rights on information of personal nature

Each User and any individual whose Personal Data are processed by the System have specific legal rights relating to your own information of personal and/or private nature in accordance with applicable laws, such as rights to demand disclosure, rectification, erasure, objections, etc. We respect your rights and will endeavour to deal with your concerns and inquiries adequately and in accordance with the applicable laws and regulations.

For the exercise of any such rights, please refer to Section 8. Please note that we may not be able to fulfill your requests in case (i) we cannot verify with a reasonable degree of certainty that the person making the request is the Data Subject, or is legitimately acting on behalf of the Data Subject, (ii) your request is manifestly unfounded, or (iii) a legal provision exempts us from complying with your request.

9 Changes to this policy

Bridgestone reserves the right, at its sole discretion, to modify privacy practices and update and make changes to this Policy at any time. This Policy is current as of the "last revised” date which appears at the top of this page. We will treat Personal Data in a manner consistent with the Policy under which they were collected.

This part provides additional information regarding how we treat information of a personal nature of each Data Subject in the European Economic Area (“EEA”) in accordance with EU General Data Protection Regulation 2016/679 (“GDPR”), the UK Data Protection Act 2018, the Swiss Federal Act on Data Protection (“FADP”) of 25 September 2020, and other national and international data protection and privacy laws.

1 Role and Responsibility of each entity

Bridgestone Corporation, represented by Bridgestone Europe NV/SA – is the Data Controller as the provider of the System, and is Data Processor in the context of processing data according to the instructions from and for the interest of User Companies. We treat the Personal Data and relevant data according to and in compliance with all applicable laws, regulations, the Policy, and the TERMS & CONDITIONS / END USER-LICENSE AGREEMENT.

Bridgestone Europe NV/SA , Kleine Kloosterstraat 101932 Zaventem Belgium is our Data Representative in the EEA.

User Company – is Data Controller in respect to the Personal Data and relative data which it directly or indirectly (by letting us collect data) submits to us, and entrusts us as Data Processor with the processing the Personal Data and relevant data it submits. User Company is independently and directly responsible to how your Personable Data and relative data treated.

2 Lawful basis of processing

(a) Bridgestone may request, on its own behalf and on behalf of its subsidiaries located in the EEA, UK and Switzerland, the User’s consent for the following processing:

  • The User’s first name, surname and professional e-mail address, for the purpose of providing or have provided information, products, services and promotions of Bridgestone or third parties, that may be of interest to the User.
  • In case Bridgestone relies on the User’s consent to process his Personal Data for these direct marketing purposes, the User will have the right to withdraw his consent at any time by using the opt-out option contained in every marketing mailing, or by contacting Bridgestone in accordance with Section 6 below. The User’s refusal to give consent to Bridgestone for the processing of his Personal Data for Bridgestone’s direct marketing purposes, shall not affect the lawfulness of processing of Personal Data for direct marketing purposes carried out prior to revoking the consent, neither shall it affect the lawfulness of data processing for the pursuit of Bridgestone’s legitimate interest as set forth in section (b) below.

(b) Bridgestone has a legitimate interest to provide User Company and Users the best possible user experience, securing its infrastructure, providing, maintaining, improving the functionalities of the System, including providing additional features and content, responding to the User’s questions and requests, sending the User technical notices, updates, security alerts and support, and administrative messages, monitoring and analyzing trends, usage and activities in connection with the System, detecting, investigating and/or preventing fraudulent, unauthorized or illegal activity. The pursuit of these legitimate interests require the tracking, collecting and storing the IP-address of the User’s hardware when connected to the internet, make and type of the User’s hardware device, the domain name from which you access the internet, the operating system and browser the device uses, the date and time when logging on to the System, or other data that the User allows the System to access on the device through the User’s device settings.

3 Source of the data

Users provide their Personal Data to us when registering and logging on to the System.
Other employees of the User Company do not directly share their Personal Data with us, but their employer, as User Company, may be able to match data generated by the System with their own personnel files.

Our sub-contractors which have a contractual relationship with User Companies for the provision of a telematics solution, may share telematics data with us, subject to the permission of the User Company, to allow us to enrich the data generated by the System.

4 Data Retention

User Company data generated by the System are retained for up to 10 full fiscal years, in order to comply with our legal retention duties under applicable fiscal and accounting laws. User registration data are deleted immediately when a User cancels his user account, or the User Company’s use of the Systems is terminated.

5 Data Transfer

Any transfers of Personal Data and relevant data into countries other than those for which an adequacy decision regarding the level of data protection was made by the European Commission, as listed on http://ec.europa.eu/justice/data-protection/international-transfers/adequacy/index_en.htm , occur on the basis of contractual agreements using standard contractual clauses adopted by the European Commission or other appropriate safeguards in accordance with the applicable law. Users have the right to obtain a copy of the safeguards, by contacting Bridgestone in accordance with Section 7 below.

6 Data Subjects’ rights with regard to their Personal Data

Data Subjects whose personal data are processed by the System have specific legal rights relating to their information of personal and private nature collected. This applies to all processing activities stipulated in the Policy. We will respect the fundamental rights of Data Subjects and will deal with their requests adequately.

The following list contains information on the Data Subjects’ legal rights which arise from applicable data protection laws:

  • Right to rectification: Data Subjects may obtain rectification of their information of personal and private nature. We make reasonable efforts to keep the data in our possession or control which are used on an ongoing basis, accurate, complete, current and relevant, based on the most recent information available to us.
  • Right to restriction: Data Subjects may obtain restriction of processing of their information of personal and private nature collected, if

    - the Data Subject contests the accuracy of its information of personal and private nature for the period needed to verify the accuracy;

    - the processing is unlawful and the Data Subject requests the restriction of processing rather than erasure of its information of personal and private nature;

    - the Data Subject’s information of personal and private nature collected are no longer needed but the Data Subjects requires them for the establishment, exercise or defense of legal claims, or if

    - the Data Subject objects to the processing while verifying whether the data controller’s legitimate grounds override his.

  • Right to access: the Data Subject may ask information regarding its information of personal and private nature that are processed, including information as to which categories of information of personal and private nature that are processed, what they are being used for, where they are collected from if not from User directly, and to whom they have been disclosed, if applicable.

  • Right to erasure: The Data Subject may obtain erasure of its information of personal and private nature collected, where

    - the information of personal and private nature collected are no longer necessary in relation to the purposes for which they were collected or otherwise processed;

    - the Data Subject has a right to object further processing of its information of personal and private nature collected (see below);

    - the information of personal and private nature have been unlawfully processed;
    unless the processing is necessary;

    - for compliance with a legal obligation which requires processing;

    - in particular for statutory data retention requirements;

    - for the establishment, exercise or defense of legal claims.

  • Right to object: the Data Subject may object – at any time – to the processing of its information of personal and private nature collected due to its particular situation, provided that the processing is not based on its consent but on our legitimate interests or those of a third party. In this event the data shall no longer be processed, unless we can demonstrate compelling legitimate grounds and an overriding interest for the processing or for the establishment, exercise or defense of legal claims. If the Data Subject objects to the processing, it should specify whether it wishes the erasure of its information of personal and private nature collected or the restriction of its processing.

  • Right to lodge a complaint: If the Data Subject believes that the processing of its information of personal and private nature collected infringes its statutory rights, the Data Subject has the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of Data Subject’s habitual residence, place of work or place of the alleged infringement.

    Data Subject’s request will be handled within 30 days. However, the period may be extended due to specific reasons relating to the specific legal right or the complexity of the request. In certain situations it may not be possible to give Data Subject access to all or some of the information of personal and private nature collected due to statutory provisions. If the Data Subject’s request for access is denied, Data Subject will be advised of the reason for the refusal. In some cases, it may not be possible to clearly identify the Data Subject on the basis of its personal data due to the identifiers which Data Subject provides in its request. In such cases, where a Data Subject cannot be identified as a data subject, it may not be possible to comply with the Data Subject’s request to execute its legal rights as described in this section, unless the Data Subject provides additional information enabling its identification.

    In order to exercise Data Subject’s legal rights in relation to the processing of information of personal and private nature collected by User Company pursuant to Section 1.(2) of this Policy(Appendix A), Data Subjects must notify the data protection responsible person at the User Company.
    In order to exercise Data Subject’s legal rights in relation to the processing of its information of personal and private nature collected by Bridgestone on its own behalf pursuant to Section 1.(1) of this Policy (Appendix A for European Union), Data Subjects must notify us by email to the Contact Information defined in Section 7 (Contact Information) of this Policy (Appendix A for European Union).
    If the Data Subject believes that the processing of its information of personal and private nature collected infringes its statutory rights, Data Subject has the right to lodge a complaint with a data protection supervisory authority, in particular in the Member State of User’s habitual residence, place of work or place of the alleged infringement.

The Systems may acquire, obtain, record and keep Cookies and Identifiers as described the Global Policy.
This Appendix B intends to explain Users our policy about Cookies and Identifiers.

1 Introduction

Cookies (which include also similar technologies such as pixels and web beacons) are small text files that we install on your internet-enabled device(s) and that make it possible for the website to recognize you and your devices(s) when subsequently interacting with us through the website. 4 How do we obtain your consent?

6 Third Party recipients and processors

Bridgestone doesn’t exchange cookies with websites of third parties or external supplier of data, with the exception of third parties working directly with Bridgestone and under its control and supervision to provide website services. Bridgestone always ensures that the processors of your data are bound by the necessary contractual clauses to keep your data safe and confidential.

Although we may use information collected via third-party cookies, please note that all third-party cookies are managed by its providers in accordance with their policies.
